Terms and conditions of use, access the content and Service Agreement

Please read the Terms and Conditions (mentioned below) carefully. This Buyer Agreement sets out the terms and conditions on which Achieve Online shall provide the goods and services  through the website. User shall be deemed to have read, understood and accepted the Agreement. By using www.bigbigbuy.com ( the site) you or the user unconditionally agree to the terms and conditions provided herein for the use of the website. If you do not agree to these terms and conditions, please end using the site.

1.    Website : The website www.bigbigbuy.com  ("Site") has been set up, promoted and  maintained, by  Achieve Online Services Private Ltd. (“AOSPL”), which term shall, for the purpose hereof, be deemed to include its subsidiaries, affiliates, partners, shareholders, directors, executives, officers, employees, agents, attorneys, accountants and any person vested with any responsibility for any task relating to the affairs of the company), with its registered office presently located at :Flat No.304, Bhagyaratna Residency, 2-2-185/56/10, Bagh Amberpet, Hyderabad.500013.  

2.    Member : To use the site and its service ("Service"), you shall have to become a member of the Site ("Member") and you shall agree to abide by the Terms and Conditions of Use, Access and Service Agreement ("Agreement") mentioned here and follow the instructions in the Registration, Use and Access  process. This Agreement sets out the legally binding Terms and Conditions for your membership. This Agreement may be modified by the Site from time to time, which shall be displayed in the site. The term 'user'  and ‘member’ may refer to 'buyer' where and as may be applicable.

3.    Objective : The objective of the site is to supply different products detailed on the site to users /members who use / become member with a bona fide intention to buy the item/s. Members provide their details BBB sets the details for delivery or further interaction and updating on  status of payment and delivery etc. BBB does not sell, rent, share, do business with or transfer any of member’s personal data except which is displayed and intended to be used for the transaction and information about promotional activities.

4.    Non-exclusive and limited license :  Visitors/Members of the site BBB are granted a nonexclusive, limited license to use and access the content and services offered in accordance with these Terms and Conditions mentioned herein.

5.    Use by Member: When the member clicks on “I have read the Terms and Conditions and I accept them”, the agreement becomes effective and binding. If the User does not agree, he/she must not use.  The member accepts to use the site for his/her own purposes only and shall not be used in connection with any commercial purpose, including framing and /or providing links to other websites. The Site reserves the right to cancel the registration of and eliminate any member, non-individual membership from BBB  or for any other use of the information obtained from the site of BBB and take appropriate legal action against such registrants, civil or criminal. Prior written consent of AOSPL is required for using with a commercial motive. BBB reserves the right to take appropriate legal action in case of illegal / unauthorized use of the Site. The member shall not : this
a.    Engage in any unsolicited advertising, solicitation, buying / selling of any products or services through the Site.
b.    Transmit any chain letters or junk email, mass mailing or spamming.
c.    Use any information obtained from the Site in order to harass, abuse or harm another person or in order to contact such person for any ulterior motive or illegal purpose/s.
d.    Use automated process to view / communicate /contact BBB or any other member of the site.
The user / member is solely responsible for the details input by him / her. BBB reserves the right to verify the authenticity of Content posted on the site. In exercising this right, the BBB may ask the member to provide any documentary or other form of evidence supporting the details posted by the user / member on the site. If the member fails to produce such evidence, BBB may, in its sole discretion, terminate Membership without any refund or explanations whatsoever. By posting details to any public area of BBB, the member automatically grants and the member represents and affirms that he has the right to grant, to the site and its Members, an irreversible, continuous, non-exclusive, fully-paid, worldwide license to use, copy, perform, display and distribute such information and content and to prepare derivative works of or incorporate into other works, such information and content and to grant and authorize sublicenses of the foregoing.

6.    Eligibility for Membership :  In order to register as a member of the Site or use its Services, you must be legally competent and eligible to enter into legally binding agreement . You are neither legally prohibited nor prevented to enter into contractual  relationship under any law. Membership is void if prohibited or prevented by custom or law applicable to you. By using this Site, you stand for and affirm that you have the right and authority, to enter into this Agreement and abide by all Terms and Conditions of this Agreement. You shall not use if you are not competent.

7.    Term of agreement : This Agreement will remain in full force and effect while you use the Site and/or as long as you remain a Member of the Site.

8.    Cancellation Policy : BBB reserves the exclusive right, at its sole discretion, to refuse or cancel any order for any reason, including unavailibity of stock, inaccuracies or errors in product, or pricing information, or problems identified by our credit and fraud detection department. BBB shall intimate on part or full cancellation of the order so cancelled. BBB shall ask for any additional information to make the transaction complete or cancel the transaction. The cancellation charges payable to the User shall be at the applicable rates laid down in the cancellation and refund policy. User / Buyer cannot cancel made to order or customized merchandise since all such items are manufactured / procured specifically against buyer/ user’s order.

9.    Termination : Buyer may terminate his/her membership at any time, for any reason by writing to  BBB at support.bigbigbuy@gmail.com. BBB reserves the right to terminate your access to the Site. If you are not eligible to a member or if you have mis-represented about eligibility, BBB reserves the right to terminate the membership and/or service. In the event of BBB terminating your membership because of any infringement / breach of the terms herein, you will not be entitled to any refund of unused Subscription fees if any. Even after termination of membership, you will be responsible for the illegality committed by you.

10.    Product Defects, and Warranty / Guarantee : Buyer  understands that the images of products shown in the site are indicative and are not identical representation of actual product.  Buyer undertakes his /her responsibility to contact / complain directly to the manufacturer / seller  for any defect in the product or for defective product on receipt of the product or thereafter.

11.    Proprietary Rights : AOSPL has complete rights in the Site. The Site contains proprietary information, copyrighted material and trademarks of AOSPL and its licensors whether registered or not.. Except for that information which is in public domain, which is posted by the Member, BBB owns and retains the proprietary rights in the Site and the Service. You shall not copy, modify, publish, transmit, distribute, perform, display or sell any such proprietary information with out prior permission of AOSPL. AOSPL reserves the right to take legal action against infringement of the said proprietary rights and for illegal copying, modifying, publishing, transmitting, distributing, performing, displaying, or selling of any such proprietary information.

12.    Rights of BBB : BBB reserves its right to : a.    monitor the use of site by the members and in its sole discretion stop / cancel and / or initiate action against such registration in case there is any violation of rules as enumerated herein, b.    review status of each membership account  and block on the basis of status, c.control unjustifiable / obscene communications at its sole discretion without prior notice to any Member. d.verify the authenticity of contact details posted in the site by a member.e.investigate and take appropriate legal action (without limitation) at its sole discretion against any user /member who violates or misuses the service , f.terminate membership of members who promote information that is false, misleading or promote illegal activities or conduct that is threatening, abusive, defamatory, libelous, obscene or promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files or provides instructional information about illegal activities such as making or buying illegal weapons or any other illegal items, violating someone's privacy, or providing or creating computer viruses or solicits passwords or personal identifying information for commercial or unlawful purposes from other users and/or engages in any commercial activities and / or sales promotion such as contests, sweepstakes, barter, advertising, and pyramid schemes or in any other illegal works.

13. Disputes : As BBB is acting only as a facilitator and providing you a platform in the Site, the member is solely responsible for his/her direct as well as indirect interactions with other  BBB Members. Though BBB reserves the right of action against members who violates Terms and Conditions, but has no obligation, to monitor disputes between the member with other member/s.

14.    Disclaimers : a.    Although BBB shall take all logical protection, BBB shall not be responsible in case such information displayed on the site is being copied / printed/ downloaded/ captured/ manipulated or misused by any member/ user for any wrongful purpose without any permission from BBB.  b.    BBB shall not be responsible for any incorrect or inaccurate Content / Material posted on the Site or in connection with its Service, whether caused by Users, Members or by any of the equipment or programming associated with or utilized neither in the Service, nor for the conduct of any User and/or Member of the BBB Service whether online or offline. c.The Site assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of, User and/or Member communications. d. The Site is not responsible for temporary unavailability of website ( as a result of maintenance work or any other reason), any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to Users and/or Members or to any other person's computer related to or resulting from participating or downloading materials in connection with the  BBB Site and/or in connection with the  BBB Service. BBB does not guarantee that system time clock will match official set time. e. Under no circumstances will BBB be responsible or liable for any special, indirect or consequential loss or damage what so ever whether in an action of contract, negligence or other torturous action, resulting from anyone's use or performance of the Site or the Service and/or any information or content posted, provision of or failure to provide services on the BBB Site or transmitted to BBB Members. The Site and the Service are provided "AS-IS" and BBB expressly disclaims any representation, any warranties and conditions with regard to the site and information contained therein, including without limitation, all implied warranties and condition of merchantability, fitness for a particular purpose, quality, performance, timeliness, completeness, title or non-infringement. The Site cannot guarantee and does not promise any specific results from use of the Site and/or the BBB Service. f.    BBB has endeavored to ensure that all the information on the website is accurate and correct, but BBB neither warrants nor makes any representations regarding quality, accuracy, suitability or completeness of any data or information contained in documents, related graphics or in site for any purpose. All such documents and related graphics are provided as is without warranty of any kind, statutory or otherwise. BBB accepts neither responsibility for any loss, injury, or damages sustained by anyone, as a result of information or advice contained on the site nor for the results of any purchase originating from this site. The use of information or purchase made on or derived from this site is made at the risk of user. g.    The documents and graphics on the site include technical inaccuracies or typographical errors. Changes are periodically added to the information herein. BBB may adopt improvements and changes in the product/s described herein at any time. h.All commercial / contractual Terms are offered by and agreed to between the buyer and the seller alone. The commercial / contractual terms include without limitation price, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties related to products and after sales services for products. BBB does not have any control or determines or advises or in any way involves itself in the offering or acceptance of such commercial / contractual terms between the buyer  and  seller. BBB shall not mediate or resolve any dispute or disagreement between the buyer and seller. i.    BBB may not take possession of any of the products or services offered on the site nor shall gain title to or have any rights or claims over the products or services offered by the user to buyer. j.    BBB is not responsible for unsatisfactory or delayed performance of services or damages or delays as a result of products which are out of stock, back ordered or otherwise unavailable. Products are offered by sellers are for limited period and for limited stock.

15.    Limitation of Liability :
Except in jurisdictions where such provisions are restricted, in no event will BBB be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from the use or non-use or inability to use of the Site or BBB Service, its astrology service  or counsel service or any other service, even if  BBB has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, the liability of BBB will at all times be limited to the amount paid, if any, by the member to BBB, for the Service during the term of membership. BBB’s limited liability will also cover any kind of loss including business loss, loss of profit, loss of data etc.

16.    Dispute Resolution :
All Disputes and Differences whatsoever arising out or in relation to this subscription order/contract or order of Service shall be referred for resolution to a sole arbitrator, so appointed by AOSPL at its sole discretion. The said Arbitration shall be conducted in terms of the Arbitration and Conciliation Act 1996 together with all statutory amendments made thereto. The Award made in pursuance thereof shall be final and binding on all the parties. The seat and venue of Arbitration shall be Hyderabad (Andhra Pradesh) and shall be governed by the Applicable laws of India. This Agreement shall be subject to the jurisdiction of the appropriate courts of Hyderabad.

17.    Indemnity :  Member /deemed member / User before using the site, has to agree to indemnify and hold BBB, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above. Member.

18.    Communication from BBB : By becoming a Member of the  BBB service, you agree to receive certain specific emails, calls for feedback and promotional offers from  BBB. This Agreement, accepted upon use of the Site and further affirmed by becoming a Member of the  BBB service, contains the entire agreement between you and  BBB regarding the use of the Site and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.

19.     Even after this Agreement is terminated, these provisions will remain in effect.
